These Terms of Service ("Terms") govern your access to and use of the Tally application and website at tallyshows.com and its subdomains (collectively, the "Service"), operated by the individuals behind Tally ("Tally," "we," "us," or "our"), based in the Commonwealth of Virginia, United States.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Tally
You must be at least 18 years old and able to form a binding contract to use the Service. By using Tally, you represent that you meet these requirements and that the information you provide is accurate.
Tally is a tool for artists and makers running their own businesses.
2. Your account
- You are responsible for the information you provide and for keeping your account credentials secure.
- You are responsible for all activity that occurs under your account.
- Notify us promptly at tallyshows.support@gmail.com if you believe your account has been accessed without authorization.
3. The Service, and its current stage
Tally helps you track your shows, sales, expenses, and profit, and (where you choose) connects to Square to import your sales and related data.
Beta and early-access. Parts of the Service — including the Android app and certain features — are offered on a beta or early-access basis. This means they may be incomplete, may change, and may contain errors. We provide beta features "as is," and we may modify, limit, or discontinue them at any time.
It's free right now. The Service is currently offered free of charge. We may introduce paid features in the future. If we do, we will make the terms and pricing clear before you are charged for anything, and features you use for free today that we describe as free will not be moved behind a charge without notice.
4. Your data belongs to you
You retain all rights to the business data you enter or import into Tally ("Your Data"). We do not claim ownership of Your Data.
You grant us a limited license to store, process, and display Your Data solely to operate and provide the Service to you — for example, to organize your shows and calculate your profit.
As described in our Privacy Policy, we may use anonymized and aggregated data (which does not identify you and never reveals your individual figures) to provide combined insights. Your individual sales, profit, and customer information are never shown to other users.
You are responsible for the accuracy of the information you enter, and for keeping your own copies of anything important to you. The Service provides export tools so you can do this.
5. Square and other third-party services
If you connect Square, you authorize Tally to access certain information from your Square account through Square's API in order to provide the Service. Your use of Square is also governed by Square's own terms and privacy policy. Tally is not affiliated with, endorsed by, or responsible for Square, and we are not responsible for Square's availability, accuracy, or changes to its services.
The Service also relies on other third-party providers (such as our hosting, database, authentication, and error-reporting services). We are not responsible for the acts or omissions of these providers beyond our reasonable control.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to access another user's account or data.
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems.
- Reverse engineer, scrape, or copy the Service except as permitted by law.
- Upload malicious code or content, or content you do not have the right to upload.
- Use the Service to store or process data you are not legally permitted to handle.
We may suspend or terminate accounts that violate these Terms.
7. Financial, tax, and business decisions
Tally is a tracking and organizational tool. It helps you see and organize your own numbers. It is not accounting, tax, legal, or financial advice.
- Tally does not calculate, file, or remit taxes. Any tax-related figures or exports are for your convenience and organization only.
- You are solely responsible for your own bookkeeping, tax filings, and business and financial decisions.
- Any insights, estimates, or aggregated figures the Service provides are informational only and are not guarantees of any outcome. Whether a show is "worth it" is ultimately your judgment; Tally does not guarantee any result.
We strongly encourage you to consult a qualified professional (such as an accountant) for tax and financial matters.
8. Availability and changes
We work to keep the Service running, but we do not guarantee it will be available, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of the Service at any time. Because the Service is in an early stage, features may change or be removed.
We will try to give reasonable notice of significant changes where practical, especially anything that affects your access to Your Data.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT DATA IMPORTED OR DISPLAYED WILL BE COMPLETE OR ACCURATE, OR THAT THE SERVICE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS OF TALLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless the Operators of Tally from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. You may export Your Data before terminating, and account deletion is handled as described in our Privacy Policy.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Virginia, unless applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect means you accept the updated Terms.
